Text messaging to consumers is regulated (TCPA in the US), and the penalties are per-message. PoolChecker Pro's position: the app makes the compliant path the only path, so you never have to think about it mid-workday.
Consent is enforced, not suggested
No text ever sends to a customer whose record lacks consent. Not reminders, not review requests, not on-my-way messages. Where a message matters, it falls back to email, so being conservative with consent never means customers miss information.
What counts as consent, and the proof trail
Each customer's record stores whether they consented, how (verbally, in writing, through an online form, at import), and when. That trio is your defense file if anyone ever asks.
- You add a customer by hand: consent starts OFF. Flip it on when they have agreed, and the source and date stamp themselves.
- A lead form submission: if the person checked the SMS consent box on your hosted form, that consent (with its exact wording and timestamp) carries onto the customer record when the lead converts and the phone number matches. Form consent is the gold standard because the proof is literal.
- CSV import: imported customers arrive with consent on, recorded as an existing verbal relationship. Audit the exceptions afterward if any of that book was cold.
The machinery that runs itself
- First-text disclosure: the first message a customer ever receives from you carries the required identification and "Reply STOP to stop, HELP for help" language automatically. You never write it; you cannot forget it.
- STOP: applies the instant the carrier delivers it. The customer's consent flips off, texting to them halts everywhere, and no one in your office needs to do anything. START turns it back on. Replies stay attached to the customer's message thread either way.
- Business hours: customer texts respect your configured hours, so the machinery is also polite.
The one thing left to you
Actually get consent. The checkbox at customer creation and the consent line on your lead forms are the two natural moments. Everything after those two habits is automated.
